New laws to increase payouts for dependents

When a worker is killed in the workplace, the dependent family members of that worker receive compensation. This amount of compensation has recently been significantly increased.

The amendments provide for a simple and equitable method for apportioning the lump sum between dependants.

The laws ensure dependent partners and children have access to the full entitlement irrespective of their level of dependency on the worker at the time of death.

This lump sum will increase from $308,339 to $570,767, indexed annually from July 1, and is two and a half times the maximum compensation payable for a non-fatal injury.

The child’s allowance will increase from $58.90 a week to $135 a week, indexed annually from July 1.

As children will also receive a portion of the lump sum, the new laws give far greater financial support for the care and maintenance of children than ever before.

Other changes will see de facto partners of workers given the same access to compensation as married spouses.

The amendments simplify the legislation and facilitate timely access to compensation for dependants through a clear claims procedure, support and guidance, and a single pathway for expedited resolution or claims.

The new laws are anticipated to come into operation on July 1, 2018.
