Sexual Harassment
Sexual harassment covers a range of “unwelcome” behaviours, which can either be deliberate or unintentional. These behaviours are of a sexual nature and can be verbal or physical.
Please remember - what one person sees as reasonable can be seen differently by the person being harassed, the person doing the harassing, and others in the organisation. Ignoring the behaviour could be interpreted as consent.
Workplace Bullying
Workplace bullying is repeated inappropriate behaviour that can either be direct or indirect. It can be verbal, physical or otherwise, conducted by one or more persons against another or others. Bullying may occur at the place of work and / or in the course of employment, which could reasonably be regarded as undermining the individual’s right to dignity at work.
Grievance Procedure
In the event that the abovementioned problems or any other grievance arise, the following grievance procedure is to be administered.
STEP 1 – Inform your Apprenticeships Australia Consultant
When a problem, concern or grievance arises, the employee or employees concerned should raise it with their Apprenticeships Australia Consultant.
If it is a matter concerning the host company the Apprenticeships Australia Consultant will liaise with the host company and endeavour to resolve the matter. Under no circumstances are employees to attempt to raise matters with host employers without direct involvement from their Apprenticeships Australia Consultant.
The aim of the parties at this stage is to resolve the matter at the workplace level.
STEP 2 – Involve the Apprenticeships Australia, Regional Manager
If a matter cannot be resolved at step 1 it shall be referred to the Apprenticeships Australia Manager who will attempt to resolve the problem with the employee/s concerned and other affected parties.
STEP 3 – Involve the Executive Director, Employment and Industrial Training Services
Matters that cannot be resolved at steps 1 or 2 shall be brought to the attention of the Executive Director who will attempt to resolve the matter.
STEP 4 – Refer to an Independent Arbitrator
Matters which can not be resolved at steps 1, 2 or 3 shall be referred to an independent arbitrator who shall be the Director of the Office of Industrial Training, an officer appointed by them, or a nominated representative of the WA Department of Training.
If an employee is under 21 years of age for apprentices or under 18 years of age for trainees; Apprenticeships Australia will involve the employee’s parent or guardian in resolving matters. Employees over the required age may involve a parent, guardian or representative for support in resolving matters.
